ASSURANCE TIRES
« on: 05-31-04 at 08:44 am »

I bought the domain name www.assurance.com in January from the previous owner.  I wanted the name for a company I started that provides Quality Assurance services.  I'm using the email address, but the site still isn't developed.

About a week ago I started hearing a advertising campaign for Assurance Tires by Goodyear, even while at the movies, there was a "commercial" for them just before the show.  "Assurance" is a TM of Goodyear.

How does that work?  Is it the word or the logo using the word that they have trademarked?

Should I have any concern about Goodyear wanting to claim trademark infringement or cybersqautting, or otherwise trying to get the domain name from me?

Is it a bad idea to try and sell it to them?

Worried and Confused...

You say that you have already started a company, and you are operating in a different field to tires. This is "good faith indepedent use", and you are likely safe as long as you don't engage in confusingly similar marks or goods/services.

Dear Wm. Loz,

Your story is why people need competant lawyers and why lawyers stay in business. You practically cannot NOT afford the right lawyer if you want to stay or suceed in business.

Don't kid yourself, JUST going to a lawyer can be just a bad or worse than no lawyer unless you can find a lawyer QUALIFIED to help you and who focuses on your REALITES.

Assurance is also a trademark of American Shower & Bath Corporation.
