CHANGED MY LOGO - MATERIAL ALTERATION?
« on: 05-29-04 at 03:29 pm »

Hi,
Thank you for your assistance. I recently filed a trademark with a stylized font set. We have since changed our logo to something that we all like alot more. The registration is coming up for publication for opposition. I would like to add the new logo to the trademark application. Does anyone have any feedback as to the best way to proceed?  If the words are the same, but the font style is different, does this change the material essence of the mark?  Thanks.

You can't "add" anything to the mark in the application. The mark displayed in a different font may not be considered a material alteration of the mark as shown in the drawing in the application, so you may get away with it. A better approach would be to file two applications, one in block letters and one in the particular font desired at the time. A block letter application "covers" the mark in all fonts and stylized versions.

Dear bill martin.
You may be able to amend the drawing.
