Hello,

I'm thinking about registering a trade mark with the state instead of going Federal.

I don't really care if someone down the road uses the same business name. However, I don't want to be forced to stop using the name by someone who registers with the feds later.

My entire business platform is Inernet, stll it will be based, registered and trademarked out of one state. Would that not protect me from someone stopping me from using the name later?

I tried getting this question answered using the number listed on the federal trademark site, but gave up after 45 min. on hold. The state office could not help with the question, they didn't know the answer.

Dear Tvalen,

A local use or a state trademark application will not protect you against being an infringer of a Federally registered mark. Try sell Coca Cola that you have made locally and see what happens!!!!!!!!!!!!!!!!!!!!!!!
