one provisional app -> multiple regular apps
« on: 12-14-05 at 12:36 pm »

Can you (successfully) file for and obtain multiple regular patents all claiming a single provisional application for priority filing date purposes?

As in, a broad provisional application was filed with many embodiments described, and then several regular applications are then filed for several of the embodiments...  Is this allowed?

If it is, then its in your advantage to file very broad provisional apps with numerous alternate embodiments, and then follow up on the best ones.  By filing several more specific regular applications, one would generally assume that the more specific patents would be more defensible...

Yes.  You can describe as many inventions as you like, even unrelated and later seperate them into individual regular applications, or even a single regular ap and wait for restrictions then crank out divisionals.

That's my understanding.
