Hello,

I recently came up with an idea for a game to be played- that helps students learn concepts during Sunday School. It is based off of a game that is already sold in stores. As far as I know, there is not a version of the game, like the one I made up, that is out on the market. However my students and friends think that it is really fun and I should patent/trademark it. (I don't even know which to do?)

I am just wondering if I could do so legally and how would I go about doing it? Would I ask the original designers for permission? Or would I just continue developing the idea of the game on my own and have a go at it..

Any advice would be appreciated.

Dear Tonya Love,

There is very much that can be done, but is has to be understood in terms of what is there and the copyright, trademark, patent law and even common law.

Without a clear legal understanding you can be haunted for years, particually if you have something good. ELAINE's Workshop® E arly L egal A dvice I s N ot E xpensive™ Reality Check®
