Trademark or copyright?
« on: 11-18-05 at 12:17 pm »

I have an idea of a design, like  a logo which would be used on clothing. I think it might be of intrest to some clothing line. I want to protect the idea do I need to copyright or trademark it. If it is of interest I would like to get some sort of royalty payment. I am retired and don't want to get involved in any sort of manufacture or importing and so on. My idea is a drawing with a couple of words which would be used on women's, and maybe mens casual clothing. Any suggestions? How do I determine if my design may be already in use?
Thanks in advance,
Steve

Without a product, you have no trademark.  Your design certainly may be protectable under copyright.
