Could test prep books for things like the SAT, MCAT, etc. be considered to infringe on copyrights as derivative works of the tests themselves?

My 2 cents:  If there's any relevant amount of direct copying, sure this is infringement.  But the "concept" of the tests are not what is subject to copyright protection.  Just the way the way the words are actually expressed.  That's why the prep guys tend to make up their own questions...
