Eyeglass Design
« on: 03-01-12 at 05:59 am »

Hi,
Are specific models of eyeglasses ever covered by any kind of intellectual property law, ie their purely stylistic elements?

Background: A few years ago I bought a pair of French eyeglasses on a splurge that are the best I've ever found because of their style-the colors, shape, dimensions, aesthetic design, and I get lots of compliments on them. But the company no longer makes them. I know that one day I'm going to break or lose these because I always do and I've had many close calls. So my plan is to try and get them custom made by a contract manufacturer in somewhere like India if I can afford it, by sending pictures of it or the actual thing.

But I'd be ripping off this French company's product (that they discontinued) - couldn't they sue me on some grounds? I also want to know because I might try and sell them since I get so many compliments on them. Would either option be legal - buying them only for myself or buying them and then marketing and selling them?

Thank you for your help.

You will need to discuss the specifics of your case with a patent attorney.

But it could be that the design is covered by one or more design patents.
