moonlighting with a criminal practice

I am aware of the C.F.R. discussing conflicts that arise from outside employment. 

My question is specifically related to whether people have been permitted to do state level criminal defense work on the side while employed at the USPTO?

For what it is worth, a friend of mine who was an examiner at one time asked if he could do this, and they would not let him. I did not get into the details, he just mentioned it in passing. Come to think of it, he did not differentiate between state or federal work, but my feeling is it would have included state.

Inasmuch as I've always been of the opinion that most criminal practices are best carried out under moonlight...

...further this deponent sayeth not.
