practitioner an inventor?

Can the following situation happen??

A practitioner becomes familiar with a client's work and thinks of an improvement for a clients current invention. The practitioner tells the client about this improvement and the client suggests that a CIP gets filed claiming the improvement. Practitioner is an inventor in the CIP.

Is this possible, let alone legal?? I haven't come across a similar situation in the MPEP

I have had this happen.  I just assign all rights to the client on the invention.  This can create conflicts of interest, but I don't think it is that big of a deal.
