Is Electronic Version Novelty
« on: 02-14-12 at 08:53 am »

There is an existing game created by x company. And I want to create electronic version for that game. Is my Idea of creating an electronic version of it novel?

For example say I want to create electronic version of chess. I can add various themes, effects and animations to the electronic version.

As of now electronic version of that game does not exist and I am afraid if I approach that company with out a patent they may or may not do business with me. What should I do? ???

Method of playing games is not Patentable in most of the countries. Subject of limitations you impose in your electronic version it can be patented, provided these are not method of playing game but construction of game. Novelty and industrial applicablity can be there, but main test would be of non-obviousness. By restricting your claims to constructional featuers, themes and effect you could try for a patent.
