Infringing Sports T-shirt?
« on: 07-29-05 at 01:01 pm »

Hi. A question about sports logo apparel: If I were to make my own t-shirt(s), to wear to games, etc. with a team's logo, is this infringing on their trademark? Common sense would indicate yes, but after reading some info on other trademark sites, a few things seem confusing, particularly as far as the useage of the trademarked image ???:
First, I wouldn't be selling it or profiting in any way, and the design in mind is similar to but not identical to a version sold in the team store, one that I don't care for, and have no interest in buying (for quality reasons).
Second, I wouldn't be distributing it to others (which I could understand as being seen as having a negative effect on the team's merchandise sales); I like the idea of having unique apparel to show my rooting interests.
Third, it is not portraying the team in a negative way, nothing derogatory, basically just team logo(s) on a shirt.

Does the non-profit/personal-use issues allow for any flexiblity in this situation, or am I still likely to be dragged out of my seat and pummeled by an usher :'(?
Thanks for any insight.
(and no this isn't a veiled way of inquiring about some nefarious get-rich counterfeiting scheme :))
