request continued examination
« on: 01-04-12 at 05:57 pm »

Hi Everybody,

Does anybody know how long it usually takes to hear anything back from the PTO after filing request continued examination?  I filed my request continued examination in last August. It was assigned to the examiner two days later after filing.   I have not heard anything.

Thank you very much,

Jin

Youjin:  I am by no means a specialist in the Examiner "count system" (available on the PTO website).  But, as I best understand it, RCEs have effectively slipped-down a bit on priority.  FWIW, I've gotten OAs within 2 months, some only after 6 months, after filing a RCE.  It may well depend on the particulars of the Examiner's own docket and the "age" of your application.

Depends widely on the art and the examiner. Oldest RCE on my docket is from September 2011. I know a guy that racks up a ton of RCEs and he still has a few RCEs filed in late 2009 and quite a few filed in 2010. Unfortunately given the new system and the emphasis on reducing first action pendency I think RCE pendency will keep going up.
