Is a single original work of art protected by first amendment ? example: a painting of a celebrity copied from a copyrighted photo.,

dear ferdie fajardo,

good question. with some exceptions for fair use,  copyrighted material is generally excluded from the "right" of free speech. (it is this tension between civil liberty and copyright law that is at the heart of the present debate over copyright extension.)

if the original work is copyrighted, you may be able to create a painting for educational or experimental purposes, or to produce a parody of the original, but a straightforward copy produced for commercial purposes is probably not fair use.

the specific laws regarding derivative works (which is what this would be) vary from country to country, but the general principles are more or less the same.
