Experienced Gurus:

After a a long dragged (unnecessarily) rej/rces and finally an interview w/  the examiner
and after interview, the "re"  search of the prior art, examiner called back and conveyed the
message that our claims are allowable and he has to present it to the supervisor and get his signature/approval.

We are aware that examiners verbal indications don't mean anything.

A few qs:

a) Typically how long would it take to clear supervisor's?
b) what would be the best way to followup w/ examiner to find out status
w/o necessarily being  too-pushy.
c) When is the best time to followup?

As Holiday season is just ahead, we would like to get things cleared asap.

Thanks a mil

PS: Happy holiday season to all on this forum.

I'd wager that it depends on the tech center and the examiner.  One data point:

After reaching agreement, I followed up with the examiner after 2 months of filing a paper that effected the agreement we had reached.  She said, "6-8 weeks".  I explained that agreement was reached and allowance could be done quickly.  Nope, allowance is the pain in the seat cushion, requiring two separate meetings with 3 superiors who are very busy.  6-8 weeks.

8 weeks later, I called the examiner again.  "6-8 weeks."  "That's what you said 8 weeks ago!"  Another examiner had quit and the queue just got much longer.  6-8 weeks.

8 weeks later:  "6-8 weeks."  Yeah, another examiner quit.

I gave up.  A new rejection on entirely new grounds was received 2 years later by a different examiner.

If your life depends on the Office taking action by a specific time, you will die.

Regards.
