Establishing ownership of a political expression
« on: 11-14-11 at 08:57 pm »

Friends,
I am asking your help in learning how to establish ownership of a political expression that has generated interest from a major political party. Is it possible to do this and how?

Assuming that the political expression consists of a small, short phrase less than the length of a sentence, there is essentially no way to own the phrase in such a way that you could prevent the expression from being used without your permission for political purpose.

Your best shot would be to start a business in which the expression was used as a mark to identify goods and/or services as coming from a single source.   You would then have a trademark that you can use to protect under trademark law.   But you could not prevent non-trademark uses of your expression.

Issac, Thanks for the speedy reply. If the "expression" is used on political posters, tee shirts and other merchandise and sold to the party's consumers does your advice still hold?

Thanks in advance
