"Occupy Wall Street" become a trademark
« on: 11-03-11 at 01:23 am »

One of the latest social movements which is a consequence of the global economic crisis is "Occupy Wall Street" which started in New York and soon spread across the U.S. and worldwide.
The name of this movement, however, can become a trademark after two enterprising Americans applied for a mark "Occupy Wall St." in the U.S. Patent Office. The mark is applied for classes 16, 18 and 25.
These two Americans are members of this protest movement that stands against the big corporations, which are blamed for the current world crisis.

Well, that's a nonsensical synopsis.  Of course it can be a trademark.  The fact that somebody is trying to register the mark doesn't make it one.

What products or services are they selling which they believe consumers associate with the words "Occupy Wall Street"?

It will be interesting to see what the USPTO decides on this and if approved, if it is contested once it is filed for opposition.

On what grounds would the PTO refuse?

I just search the USPTO and it look like that 2 applications file for "Occupy Wall Street" at the same day 2011-10-24 - BUT, both of them will need to overcome the third application "Occupy" SN# 85453994 (class 25)   from a day before 2011-10-23 - Interesting :)

Well, since they are part of the 99, and they oppose any form of capitalism and the greedy 1%, that they will certainly share any monetary gains from their enterprising efforts with all the other 99ers.  So the USPTO should allow it on the basis that it is good for all of mankind.
