Filing for PCT
« on: 10-26-11 at 09:42 am »

Hi, I think I am in trouble and would like some help.
I have filed a non-provisional patent application on 12/30/2010. But I concluded that the application did not present my invention properly and had quite a few loop holes.
Disappointed large time with the patent lawyer, I went to a law firm specialized in the specific field of my invention for preliminary amendment around April 2011.
After six months, we only reviewed it twice and the amendment is not done yet.
The issue is that I believe in my invention and am planning to go for PCT.
My initial plan was to complete amendment first and file for PCT.
However, in current pace with this lawyer, I have big doubt that I can file for PCT by the deadline, which is 12/30/2011.
Can someone advise me what I should do to file PCT before deadline?
Thank you for your help in advance.

Sounds like you should hire a new attorney.

same answer as above. Also, depending on what you meant by not presenting your invention properly it potentially can't be fixed by a preliminary amendment.  No new matter is allowed.

Thank you, George & bleedingpan!

That is what I thought, hiring a new attorney.
I am getting a reference from someone reliable.
BTW, regarding the amendment, at least this lawyer did not object my request so I guess it is fixable.
Well, I will work it out with new lawyer.
Thank you for your advice!
