Open source licenses

Hello.
My client want to use BFA firmware driver in his software application. On web-site http://www.brocade.com/services-support/drivers-downloads/CNA/Linux.page. Before download you must agree not to sell/redistribute this package. So, the only exit is to buy license. But lately there be found that exactly the same package is located in free Fedora Core rpm package with BSD 3-clause license. According to license, client can use/sell/ redistribute this component for free.
Why? Contents of package is the same, but in 1 case I need to buy license in another don’t need.
