I have read page after page of before and after 1978 copyright office infomation...  And I still cannot find a difinative statement on how you would treat this question.  

Can you produce a work of commentary based upon an ancient literary works?

My definition of ancient would not include stuff published
anytime during US history.  That material was never protected
by copyright in the US.

You can produce a "commentary" about a current, copyright-protected work without violating copyrights, if I understand the question correctly.  With that in mind, the classification of the work as "ancient" is besides the point.
