Trademark search companies?
« on: 06-16-11 at 09:00 am »

Does anyone have a trademark search company they can recommend based on experience. I found a few by searching and have one (Cardinal IP) which sent me some literature a while back, but was hoping to find one where the quality can be testified to.  Looks like the average cost for a comprehensive TM search ranges from about $350-$450.
Thanks in advance for any assistance.

I do them myself, so I don't have anyone to recommend.

just make sure you compare apples to apples.

There's many different kinds of "searches", and some efforts result in a "report" and some result in an "opinion".

If you find what looks like a really, really cheap search, there is probably no opinion that comes with that.  You probably know that, but I find myself explaining this to people/clients more often that not.

I typically do a search using USPTO database and SERION engine from Thomas Compumark, which I feel fairly comfortable with and provide an opinion based on those results.  But I wanted to begin to offer a full comprehensive search using a search firm which would hopefully include common law marks and ancillary marks I may not find, if clients so desires.  I would then provide the opinion based on that search report.

I've USed Thomson Compumark, and they do a comprehensive US search, but are pricey ($600 or 650 these days for a word mark?)... I've seen literature from Cardinal IP and was considering using them as well, Yak.

I used to use Thomson when they ran Trademark.com.  You paid a flat fee for 12 hours of unlimited access to their database and could fully review as many marks as you wished. Now they changed their service to a pay per click (for each level of information for each mark) with this SERION service.

I did see that they offer a full US search, but like many of the other websites I've found for search companies, they do not seem to post their fees, or at least not where they are easily found.  All I can find is a request for them to contact you.  At least Cardinal explains fees up front.

There were a couple of attorneys who contribute the trademark e-listserv (http://www.oppedahl.com/e-trademarks-l/) I subscribe to that have used Cardinal and said they were satisfied with the quality and results, at least for the lower price, in response to this question.

I was using trademark.com as well.  I now use Saegis and some Westlaw databases.

I pay for a searches by Creative Trademark -- which covers the federal USPTO database, all 50 state trademark databases, internet search, domain search and business directories.  They run a search for the mark in all classes and for similar sounding marks.  I then review the report and provide a legal opnion.  The report is $259, and I charge for my time to review it and opine.  A typical report is 125+ pages.

Thank you all for the input.

From the trademark listserv participants, here were some other companies that seemed popular for anyone's information:
-Boise. AJ Czopek - eklektyz@gmail.com (former trademark searcher for http://www.avantiq.com/, now working as an independent contractor)
-CSC (Corporation Service Company) Corporation (formerly known as NameProtect)
-CT Corsearch
-Government Liaison Services (http://www.trademarkinfo.com/trademark.html)
