photos & copyright protection

Here's the scenario. A hockey jersey collector has amassed a very large digital library of game photos from multiple sources including books, team publications, newspaper websites and team websites.

For a fee ($50 to $100) he now offers to search his library to find a photo that matches the game worn hockey you own. As part of the service he sends you a "free" photo to document the match.

Is he violating copywrited work when he includes the "free" photo as part of his service?  Either digitally or through the US Mail?

If you could point me to any clarifying literature I'd greatly appreciate it. Thanks for your time !

My gut says there is likely copyright infringement.
