Hi,

I intend to use a photograph taken of the patterns / design of a fabric, for the cover design of my book which will be published and sold publicly. Except for a small box containing the title of the book the rest of the cover will be an image of the fabric design. The image used is only part of the whole design of the fabric.

Assuming the fabric design is protected, does anyone knows whether my usage in the above manner infringes the design owner's rights ?

To the extent that the design at issue is protected by copyright, your use likely would infringe that copyright.   Only a detailed discussion with an attorney can get you a better answer.
