Copyright Registration Question
« on: 05-30-11 at 10:26 pm »

Hello Folks,

I have a rather simple question that has been plaguing my thought process (so to speak).

About a week ago I finished designing my company's logo and I've almost completed the copyright registration process. However, one question from the Copyright application haunts me:

Has this work been Published? Yes/No

Tell me if I'm wrong but I would assume my company logo would not be classified as a published work - Right?

Any help would be greatly appreciated.

Thanks.

Well, let's look at the definition of "publication" in 17 USC §101:

Quote
“Publication” is the distribution of copies or phonorecords of a work to the public by sale or other transfer of ownership, or by rental, lease, or lending. The offering to distribute copies or phonorecords to a group of persons for purposes of further distribution, public performance, or public display, constitutes publication. A public performance or display of a work does not of itself constitute publication.

So, if copies of the work have not been sold, gifted, rented, leased, lent, or whatever, the work would be considered 'unpublished'.  Depending on the uses to which you have put your company logo up until now, it may or may not be published.
