cover sheet and application data sheet
« on: 05-25-11 at 12:20 pm »

Hi Everybody:

Do you know whether a cover sheet and an application data sheet are required by the US PTO for non-provisional patent application, if efiling is used?   Thank you very much!

Neither are required, but I'd strongly recommend the ADS.

Regards.

I second. The USPTO electronically transfers information from the ADS form to their internal databases. If you use a transmittal form, a human types in the information, which is obviously prone to error.

I don't know what happens if you e-file without either one. Never even realized you could do that. But since you type in various pieces of information (e.g. first inventor, title) as part of the e-filing process, maybe the USPTO electronically transfers what you typed in.

Keep in mind also that one of the Declaration forms from the USPTO requires that you use an ADS.
