Patent Valuation
« on: 05-10-11 at 12:00 am »

Hi All,

I need some guidance and help on the ways to value a patent.
Please help me in deciding on the parameters that can be considered to value it.

Thanks in Advance

A few years ago, I attended a 2-day symposium on that very topic.  Unfortunately, nobody knew how to do that.  Kinda useless, huh?  Except that it really pointed out how complex the task is.

Each patent has to be evaluated in terms of the amount of advantage it gives to marketplace players.  I know that's not helpful, but it's the truth.

Regards.

As much as the next guy is willing to pay for it.

Consider, length of patent term, amount of revenue able to derive during that period, (if not yet earning revenue) how speculative revenue stream may be, likelihood of design-around, likelihood of litigation (enforcing can be expensive), density of patent field (ie will you need other licenses to even practice this), and marketing/portfolio benefits that come with.  As you can see, each non-exhaustive factor has within it tremendous room for guessing.  As with everything, start the bidding high and let them work you down.

I think, except in the rare case where the patent has already been licensed or covers a successful product and therefore has an easily established objective value, patent valuation is about as useful a science as lottery ticket valuation, but alas it's still considered de rigueur for due diligence.

The article behind the link shown below is a good place to start.
