Is utility filing constrained by provisional
« on: 05-03-11 at 03:07 pm »

I am looking to convert a provisional patent filing into a utility filing.  Of course, in the months since we filed the provisional, we have learned many things about our invention that broaden the features.  Can my utility filing claim the broader aspects of the invention, or can my utility filing just claim what I have taught in the provisional and I need to also file a continuation in part?

You can add stuff in the real application.  The relationship between a real application and a provisional application is similar to the relationship between a CIP application and its parent application.

Regards.
