I am a producer and songwriter working with a artist in the music industry.  We were singed to an independent label for from December 1, 2010 to April 1, 2011.  We released a song through a digital distributor on April 3, 2010.  The record label we were signed to released the same song (produced by me and written by my artist) with the same distributor under the Record Company's name.  We sent them our copyright registration form to the distributor and they removed his fraudulent copy. A member of the company sent in a counter claim against us, purely out of spite claiming to be a copyright claimant.  Now this is the current situation why I believe I need an attorney, but can't afford one.  We have the copyright Registration dating back from June 2010, we also have the notarized release form for the artist releasing her from all contractual agreements with the label and releasing her, her music, her image, her name or any recorded material from any claims of the company.  That was on 4/01/11.  The independent record label was dissolved and I have the dissolution papers from the State Department of Florida saying that the company is now closed effective 04/11/11.  The claims by the company to the distributor was made on 04/13/11.  This individual is bitter that in our first week we have projected and confirmed sales of almost 30,000 units and thats with no promotion or marketing.  This individual is trying to stop our sales momentum and because he has his millions he told us to get our attorney because he has the money to win any case.  I need a Pro Bono attorney or an attorney that will work on our case and be paid after final judgement when he loses.  He is also the same person (con artist) that was behind the FAKE DRAKE concert in Pennsylvania.  He is currently being Federally investigated for defrauding the Sherman Theater in Pennsylvania. (Just google SHerman Theater Drake Concert).

I need Help and legal advice please. Our distributor wont turn over any monies to us or put back our song for sale without a court order.

If you haven't done so yet, check out some of the various "Lawyers for the Arts" groups, e.g.:

http://www.thewala.org/
http://www.calawyersforthearts.org/
http://www.vlany.org/aboutus/index.php
http://www.law-arts.org/

Hopefully, one of them can help connect you with counsel that can help.  Also keep checking back here.  We don't have many copyright folk active on the board, but some helpful posts may yet come in.

Good luck.

This post is an off-the-cuff musing and should not be misconstrued as legal advice. THERE IS NO ATTORNEY-CLIENT RELATIONSHIP BETWEEN US. Proper legal advice requires full disclosure of facts-not appropriate to a public forum-and attorney research time and effort which has not been expended here.
