Copyright Deposit
« on: 04-19-11 at 09:51 am »

Lets say that I'm creating aT-shirt with an original Artwork (painting) on it.  I'd like to Register the T-shirt.  Let's also say that I've sold the T-shirt already (just in the last 8-10 months) so it is a Published Work.

When Registering the Visual Ard Work, what do I submit as a Deposit (According to Circular 40A, I believe I need '2 complete copies' of identifying material):

What is meant by "2 complete copies"?  Two identical/exact .JPG images/photographs of the actual painting on the T-shirt (That I can attached as a deposit copy with the Copyright Application)?

or

2 Representations of the painting, for example:
A photo of the artwork itself separate from the T-shirt?
A photo of the T-shirt showing the artwork?

And, to show copyright notice:
If my Copyright notice is on a label attached to the T-shirt (rather than embedded in the painting printed on the T-shirt), do I also include a Photo of the T-shirt with the Label showing (Per Circular 40A "Copyright Notice' Section)?

Thanks

(1) As a practical matter, the Copyright Office will accept your application with one .jpg uploaded along with your application.

(2) You don't need to show them the copyright notice.  A notice is completely optional post-March 1989.

(3) You're not registering your t-shirt -- you're registering the artwork printed on your t-shirt.  So either a photo of the artwork or a photo of the t-shirt with the artwork will work.  (See Circular 40 for the description of a "useful article" and what's actually copyrightable on a useful article.)
