Re: infringement and likely to confuse - communication system (class 9 and 38)

There exists a class 9 word-trademark for a one-way information notification service primarily marketed to the travel industry (Airports, Cruise ships, and their customers) which utilizes hand-held pagers, software, telecom equipment, and ties into backend travel databases.  I'm interested in the same word-trademark but for class 38 (perhaps class 9 too), for a two-way general purpose communication system which uses telephones and the internet and is sold/marketed to the general public and businesses with no focus or tie-in to the travel sector.  Would it be foolish to think there would be no risk of consumer confusion and/or infringement/lawsuits here? ie, because they are both "communication systems"???

Possibly.  You would need to explore the DuPont factors in more detail, including channels of trade and sophistication of consumers.
