1000 can not be a trademark

The Polish company Agencja Wydawnicza "TECHNOPOL" Spólka filed an application for European trademark consisting of the number 1000. The mark is applied for Class 16 - printed materials, crossword puzzles and Class 41 services related to organizing games, publications and so on.
OHIM refused to register the mark for Class 16 on absolute grounds because it considers that mark is descriptive about these goods.
The Polish company appealed that decision to the CFI. The Court upheld the refusal. This decision was appealed again.
Recently, the European Cour hast issued a final decision on this dispute.
According to court the figure 1000 can not be a trademark because it is descriptive to indicated goods.
Furthermore, 1000 shows the quantity that may lead consumers to confusion about the number of goods offered by the company.
Actually this decision of the court has rejected the registration of number as a mark under certain circumstances described above.
