2D and 3D LOGOS
« on: 03-16-11 at 06:43 am »

I hope you're having a great day.

I have a trademark. I want to get it 'registered' - in Canada - and then in the U.S. [And hopefully - if all goes as planned - other countries]

It's a simple 2D logo. [Imagine four straight lines meeting together to make a 'box'. Almost that simple - but not quite!] The same logo will be turned into a 3D image. [Imagine that same 'box' with another 'box' half way down and half way over with all of the corners connected by a line so it now looks 3D - just like most of us have doodled]

QUESTION:

Would I have to 'register' BOTH the 2D 'box' AND the 3D 'box'? [The 2D image matters more to me - just so you know] Money is BIG issue here - so I only want to do what I HAVE to do!

I'll post another message [If that's OK] to ask my other question.         Thanks, Craig!! [From CANADA]  :)

Which logo are you actually using?

BOTH!  But mostly the 2D version.

That said - there is no way anyone would ever NOT think that the 3D version isn't just a three dimensional version of the 2D version. [If that matters]

Given that fact - would a 'registrar of trademarks' reject any attempt to 'register' a 3D version of my 2D 'registered trademark'? [That's mostly my concern]

Thanks!! :)

If it's written on paper, it's 2D, not 3D.  A 3D logo would be signage or the like.

Regardless, the mark is the logo as used.  That's what you should register.  If you have two different logos, ideally, you would register both.
