Not patentable but still awesome invention?

So what if you have an invention which might not be patentable for something like it not being completely novel. It's still a great invention though and has a lot of commercial potential.

What kind of legal protection can you still get for it?

Possibly, be the first on the market with this not new, but whiz-bang product and secure a good tradename for the product such that people will identify it as the source and only want that one.

To piggy-back on Yak's comment, many times the company first to market, who does a great job marketing the product and most importantly, builds a great brand name, will capture and hold top of mind of the consumer when it comes to your product versus your competitor.

You can have the stupidest product out there and with great marketing behind it, people will buy it.  And you can also have the greatest product out there and with a poorly designed and executed marketing plan, the product will flounder.

It's all about the marketing!!!

When done well it can be very powerful.  When your first product is doing well, you should have been working on the next WOW idea to continue your sales growth and become even more entrenched in the minds of the consumer.

And get a patent on the next version of the product.

Also consider design patents and copyrights for the first iteration.  Maybe you can make it look prettier than the competitors.  Some technology products are more fashion than functionality.
