Question on use of trademark
« on: 02-09-11 at 05:55 am »

Hello Everyone,

I am in the process of launching a new clothing line and I have a couple of questions concerning my business name and logo and getting a registered trademark for it. I have searched older post, but I am a little confused on the following. I am going to present a fictitious name to demonstrate my question.

Lets say the name of my new company is Puget Trading Company (Puget is from the Puget Sound) - and I have developed a logo mark to go with it. On my shirts though, I am wanting to print just the word Puget with the logo mark displayed above it.

1.  When I register for the trademark, will I have the ability to use the just the word Puget on my shirts(along with the logo mark above) and still have trademark protection? I dont think I have the ability just to register the word Puget since it is a geographical location- correct?

2. Do I need to register the name and the logo mark separately if I use them individually?

Thank you for any advice on this matter.

If you use the mark both ways, or if the "Puget" element of the larger mark functions independently as a mark, then you can register both.  If you search the TMEP for "mutilation" (I kid you not), you'll find relevant discussion of the issue.
