Wouldn't a non-disclosure agreement with your developer work just as well?  You could make whatever you would file as the provisional part of the agreement.

Some inventors use provisionals to protect against loss of foreign filling rights from a journal article publication or conference presentation.  I haven't heard how that works out for them.

What are you trying to accomplish with the non-disclosure agreement with the developer?
