Are cookie designs copyrightable or only protectable by design patent?

Inasmuch as the 'design' of the cookie includes non-functional, creative elements, those elements might be copyrightable.  For example, the graphic design elements on the face of an Oreo cookie may very well be subject to copyright protection (not to mention trademark protection), while other aspects of the cookie design, such as the circular shape, would probably be deemed to be purely functional or non-expressive and thus not subject to copyright protection.
