a video that contains copyrighted music?
« on: 12-12-10 at 12:16 pm »

I'm about to register the copyright for a video I made, but before I do wanted to ask a question.
I shot video of a notable band at a CD signing.  In parts of video, their music is loudly played in the background through giant speakers for hundreds of people to listen to. their songs are obviously copyrighted, so not trying to lay claim to that part of the audio.

So what I'm curious about- in the LIMITATION OF CLAIM section on eco.copyright.gov, should I be checking off "Preexisting music" under "Material Excluded"??

Don't know if I'm getting too wrapped up in specfics, just want to make sure I have my ducks in a row.

thanks all in advance!!

Yes, that's the way you would do it.  Describe the preexisting material as "music and lyrics" and the new material as "video" or "audiovisual material" or something like that.
