    • IveyLaw -- Turning Caffeine into Patents(sm)

How to get your idea manufactured really isn't a legal issue, but maybe some of the inventors here will chime in.

From the legal perspective, you need to know that you must have a properly-prepared patent application on file prior to your (or anyone's) first publication, first sale, or first public use of your invention to preserve your patent rights.  If you're okay limiting yourself to just the US, Canada, and 1 or 2 others, you have one year from your (or anyone's) first publication, first offer to sell, or first public use of your invention.

It's also important to note that a provisional application that is not prepared as carefully and thoroughly as a real application is not "a properly-prepared patent application."

Regards.

Keep your design secret until you lodge your patent

even consider getting a Patent search done first before you file, so you know what you are up against

spend 2-3 weeks doing market research, the amount of times a inventor comes to me and I find a very similar product in the market is crazy, in 20 minutes on the internet searching

google image searching with key words can be helpful

Step 1: Buy or borrow from the library the Nolo Press "Patent it youself" book.
Step 2: ???
Step 3: Profit!

Actually I am serious. That book is not just for patenting stuff yourself, but
it also has some basic info (even flowcharts!) that address your questions
directly. What steps to take evaluating an invention, to patent or not to patent,
etc...

Hi mhdeaton,
Below is an example of a new product, that was Licensed without a (prototype or Patents from the start), we only supplied the 3D CAD Files to the manufacture and manufactures drawings, so there are many ways you can do this and its all about the different risks, personally this game is so full of risks anyway, by taking more risks you spend way less.

spend more and than should mean less risks in theory, talking to other Inventors, their general comments are (IF IT'S GOOD ENOUGH) or the (LEVEL OF INTEREST) these are key elements that help drive your product into the market place and of course pure determination by the Inventor!, the driving factors need to come from Manufactures, brands, importers, distributors retail stores and the end user, not the Inventor or their friends, outside real interest is what is needed.

This was done with a NDA from the start, I find Taiwan Manufactures are keen to claw back market share against China and will pay for Patents to do that!

The New Product:

Features below:

These are my personal methods only and talk to a Patent attorney if you have concerns first:

Hi mhdeaton,
Below is the China Prototype company I used, they did a great job and have a secrecy agreement for 2 years in their invoice:
