Is "Unforgettable" by Nat King Cole protected?
« on: 11-06-10 at 12:39 am »

Looking to use this in a short film I'm producing. Unfortunately, it's extremely difficult to get a definite answer. I need to know if it is legal to use the original recording of "Unforgettable" by Nat King Cole in a short film.
Any help is appreciated
Thanks

I believe that "Unforgettable" was written by Irving Gordon.  Harry Fox lists that song as one they offer mechanical licenses for.  (Which isn't to say they'll sell you a license to use the Cole version - instead, Harry Fox will sell you a license to perform that song yourself and release copies of your performance.)  Please someone correct me if I'm wrong, but I would take the fact that Harry Fox is selling licenses to mean that the song itself is indeed protected by copyright.  But again, I could be wrong.

I believe anyone can do a cover of any song so long as they pay whatever costs associated with doing covers.

Not sure if it is in the public domain yet--check with Harry Fox.  If not, you'll need both a sync license (for the composition) and a master license (for the sound recording).
