Approved Australian Patent in 2007
« on: 10-29-10 at 05:32 am »

Is it possible to save a new product with only an Australian Approved Patent in 2007 and legally lodge an Europe Patent?

I have been told it could be possible? can this be done 3 years after the first Australian Patent by the same Inventor?

As what has been proven to me in a previous post, the Design Patent option will not work to save the I.P

Thanks

If the AU patent was filed or granted in 2007, it certainly has been published at this moment. This means that it will take away the patentability of any European application that is filed on the same subject matter after this publication.
There is no way that an Australian patent can be 'converted' to a European patent (application).
