I have submitted my resume for a patent agent job. However, I don't have a writing sample. I haven't worked as an agent before, and I cannot get anything I have written for my previous employer.

How can I go about writing a sample from scratch? I'm not even sure what I should write. I assume something technical. Writing a legal memorandum wouldn't make any sense for an agent job. I'm not a lawyer.

How about create an invention in a field you are comfortable with and draft a "mock" application based upon it.  No need to necessarily care if it is novel or non-obvious.

Just want to state the obvious, in case you hadn't considered it:  Assuming you did patent prosecution work, have you checked public pair for some of your written work?  I don't see any reason you would need permission from your previous employer if it is a publicly available document.
