HI all,

At one point we were thinking of moving to Austin, TX, but my wife just can't bear the thought of hot weather without a nearby beach.  So, we are back to considering the Jacksonville area.  Any thoughts on the difficulties on moving a solo patent practice across the country?  I am originally from TX, so that was one of the plusses of moving to TX, because of my built-in contacts.  Florida will be a new state for us, we have a few friends and family there, so my networking will have to be increased to develop my practice.  Any thoughts?  Thanks.

My understanding is that you will have to take the FL bar and cannot be simply sworn in via reciprocity.

I plan on taking the Florida bar.  The bar fees go up the more years you have since your first bar exam.  I get to pay $2000!  I think $2500 is the max you pay if you have 15 years since passing your first bar.

On the other hand, if you practice only patent prep and pros (and arguably trademark prep/pros), then I don't have to have the Florida Bar (see Sperry v. Florida).  However, in order to avoid problems regarding preparing and revewing contracts, licenses, etc, and to keep my options open to do litigation, the Florida bar is something I plan on taking.

Yeah, I think it would be OK for a handful of attorneys in a firm to not be licensed in that state, but if you are going the solo route, I think you need to take that bar.

So on that note, take the FL bar first before relocating.  :)  My understanding is that it is not an easy bar exam.
