Hello, I want to open a website where users can exchange their music files with all the users on the internet.

Rules of the web:

-The media file must be created by the user.
-No copyrighted material permited.
-There is a link in every song where a user can "Denounce" that the song may be infringhting the copyright.
-If copyrighted material has been found the user will be banned permanently.

I know that I can't control everething that the users do, what happens when a user uploads a copyrighted song?

Until where goes my responsibility for what the users do on my website???

(I supose that if there are websites like youtube, megaupload, and so on.. and they can survive the tons of copyrighted materials that are uploaded everyday.. why could't i make it too?)

That's a hard question to answer. Problem is different countries have different laws and then there are international copyright laws that may affect the answer to your question as well. Most of the advice you get from this forum is based on US law, and while many countries adopt similar laws, what may or may not apply is really a question that cant be answered by anyone other than a lawyer from that country.

What laws do you need to know, ... well it depends on where the ISP is located and where the clients are ect which is why any internet copyright questions is always complicated.

In the US however, if you follow the DMCA laws, then you'll be cool. Essentially as long as you take down material when you receive a valid takedown notice , then you'll be free from any liability that web users may create. Obviously it gets more complicated than that, but all things considered it a good place for you to start researching for info. Im guessing Spain has their own variation of a DMCA.
