IP Violations - Needing Help

Hello

I created a "piece of intellectual property" at the request of a client for use by another organization.  The "piece of intellectual property" was not sold but licensed  for a certain period in a particular form, etc.  There was a contract in which all of the details of usage and license were stated.  The original "piece of intellectual property" was never returned, not used for its intended purpose, or exclusively in the form for which it was licensed. We are talking flagrant disregard for the all but one of the terms of the contract.

I've been trying to handle this myself and I have already filed suit for one portion of the contract. The contract states that in the client will be responsible for reasonable legal fees.  I would like to get an attorney however, I've been too nervous to do so in the event that I may lose.

I have a few questions and I would appreciate any advice.

1: Is this a contract case, a copyright case, or both?

2: Are there any legal firms that might accept the case(s) based on their strength?--Does "no fee unless we win" exist in the intellectual property legal field?

The case sounds like it is likely both a copyright case and a contract case.

Some lawyers will take IP cases on contingency fee, but it may be difficult to find one, particularly if damages are difficult to prove.

Do you have a copyright registration for the work in question?
