My SPE left us an email yesterday basically saying that he would not be waiving them.

That's unfortunate Examinerguy, I would have thought the situation over the last four days presented sufficient extenuating circumstances to justify waiving workflow points.

You don't get "other time" or a reduction in examining hours when the PTO closes?

And there is no consideration for "2's" either?
You get accused administrative leave for snow days. That doesn't stop the hard deadlines for things like clearing the oldest new case every 2 biweeks, after finals, etc. The negative workflow points are assigned automatically and it is up to our SPE whether to waive them.

I could understand that if an examiner is hotelling.  No need to defer the hard deadlines when the Examiner is capable of working from home.  But for examiners that actually work on site, that is a fairly brutal policy.

If the negative workflow decides whether you keep your job or not bring it to POPA and make noise.

Good luck!

I know SPEs out there that would say "Well you had two months to do it. You shouldn't have waited until week eight." Still I would be shocked if there's not a forthcoming email from Peggy Focarino saying all workflow points are excused.

I only have 2 two monthers and one AF. The two monthers are both quick finals I can do tomorrow or Saturday. The AF is not really a problem either, since my AU excuses workflow points when the response is mailed within 30 days from when the office received the response (not when forwarded).

I really can't see them closing the fed again. I'm thinking liberal leave for tomorrow.

Except as far as I know only the red line is running above ground.

Edit: Open with 2 hour delay. What a horrible call! The metro isn't working yet, which will cause more traffic and the streets aren't even clear.

From TC2600 directors:
Workflow points - Note that any negative workflow points, for all examiners, for this pay period will be waived.  However, it is recognized that this may cause a larger volume of amendments to become due next biweek.  If you will not be able to complete all of their work under the work flow element, given the unique circumstances of this past week, please send an email to your Home SPE early next week.  If you have an unusual number of amendments that are due next biweek,  please let your home SPE know so we can work with you on a plan to get these completed over a reasonable period of time.

About the letter to registered Agents/Attorneys encouraging experienced practitioners to apply as examiners, do you think it's worth applying right now if you're a newly minted Agent with no experience?

Here is an interesting remark from the "just an examiner" forum that may provide some insight. Of course, it is just someone elses opinion. I am not sure how he/she knows there will be a 200-300 million fee diversion, but I would not doubt it:

"Keep in mind that Congress will keep the $100 million plus fee diversion for FY2010, preventing the PTO from any meaningful hiring for this year, then will siphon off $200-300 million from the PTO budget in FY2011. Filings will be down due to the increased surcharge fees, and the PTO expected budget of $2.3 billion will be much lower. In fact, with Congress set to divert $200-300 million next year, and the ACTUAL PTO revenue being much lower than the anticipated $2.3 billion, the PTO will probably be where they are at this year - around $1.9 billion, and therefore will be unable to hire next year as well."

It's still "count monday". The 2 hour delay doesn't delay when you have to get things in right?
