i have just recorded a c.d. of railroad songs & i found a poster in a catalog that i would like to use on the cover.the artist died in the mid 80's & i have tried to contact his family to no avail.can i use this artist's work w/out permission from the people who own it?

If the work is still under copyright, your use would likely infringe the copyright regardless of your fruitless attempt to contact the copyright holder.
