new product old container

Hi everyone,

I have a new product idea that i want to start selling. This (liquid) product is going to be sold within a container that already exist but is not being used along with the product that I want to sell. I wonder how to avoid that other (bigger) companies copy my idea and start using it with their products. Do I have to patent my product along with the container?

Is it possible to sell this idea to a company, without developing anything? the idea about selling this 2 products together.

I hope i explained myself clear.

If you patent the product in the U.S., you will have the exclusive right to make, use, sell, offer for sale, or import the claimed invention in the U.S.  Provided your product is adequately covered by the patented claims, a third party (e.g., the company in your hypo) would not be able to use it without infringing your patent regardless of whether you patent the combination of product and container.

It is possible to sell an idea to a company without physically developing a product.  It is not easy, however.
