Patentable Material in Japan

Hi

Just a small query with regards to patentable material in Japan.

Essentially, I am employed in a Japanese firm as a research scientist. I have developed patentable material, and have logged a continual record of the process in a lab notebook (countersigned). The project however, is scheduled to be canned before a patent application can be made.

My question  is, has anyone in a similar situation  been able to negotiate ownership of their research and continued this work at another institution (either in Japan or overseas)?

Secondly, if a researcher was unable to negotiate the rights to their research, but STILL took the work elsewhere, and it DID eventuate into a patent, would there be an infringement?
