The company I work for is in the business of developing certain compositions for certain applications. For the time being, we are maintaining a particular composition as a trade secret. We routinely ship samples of our composition between our test facility (located in state A) and our laboratory/R&D facility (located in state B).
Recently, one of our engineers proposed drafting an MSDS for the composition in question, so as to facilitate its transport across state lines. In my view, this would pose a trade secret problem, as we would likely need to post the composition (percentages and all) on the MSDS (a document distributed outside the company).
Does anyone have any ideas as to how we could address this problem? Ceasing shipment of the composition is not a possibility. I am aware that the EPCRA includes provisions for trade secrets, but have not had a need to invoke those provisions in the past.
