Hello,

I have a question re: revoking an existing power of attorney (POA) and granting a new POA in an international (PCT) application.

I know that under PCT rule 90.6, an existing POA can be revoked by the applicant at any time by submitting a new POA. However, it is unclear to me who must sign the new POA, when both a corporate entity and individual inventors are listed on the PCT request as applicants.

Under the U.S. rules, an authorized representative of the assignee of a U.S. application can sign a revocation and grant of new power of attorney under 37 C.F.R. 1.32(b)(4) (possibly with a statement under 3.73(b)).  I am not certain whether the same is true in the PCT context, however,  or if both the authorized representative AND the individual inventors need to sign the new POA for it to be valid.

I know this is a bit of a newbie question, but it has been a long time since I have had to handle this type of issue myself.  So, any comments/assistance would be appreciated.

Thanks,

Klav
